Because, like others, I don't think that rights are derived from government or society. I think that they are infringed by them. So it'd be more like 'you have unlimited rights unless you agree to your social contract and cede rights'.
But I'd think a fetus or a baby are precluded from Hobbes because of their state of development -- a stage we all pass through. A one year old hasn't contributed to society either, thus you could say that their right to life, etc, is a sham also.
