Just to clarify any potential confusion, any increase to this cap would not be retroactive, and thus would not apply to BP for this current disaster. Current indications from BP, however, are that they will pay beyond their legally-mandated $75mil cap anyway, although whether they actually follow through on that remains to be seen.
