This is what the legislative branch is there for ... though it's a bit disappointing that indefinite detention and secret military trials is apparently fine until its American citizens that get involved (i.e. Guantanamo and its friends haven't been declared to be illegal).
Civil liberties are important and it's easy to lose them if you don't keep it in mind when voting for your representatives. In this case, think: would your Congress or Senate representative vote against this if it came to their house? (Presidents and national leaders often go against what you'd expect from their campaign speeches and I wouldn't trust Romney to be any better.) But the courts act as a last line of defence when governments try to pass something that's actually illegal.
