Usually in stalking cases, the stalker has to do something "actionable" before the law can intervene, such as make a threat or cause physical harm/damage. Advocates for stalking victims say that waiting to act until such escalation occurs is dangerous and also ignores the problem of the stalker who manages to cause great psychological harm while remaining within the law.
