Legally, potential is often the same as actuality. Sometimes it's not. Which applies to abortion?

I said this elsewhere: I have the potential to go murder someone, yet I am not legally accountable for that potential.
Actually, now that I'm thinking about it (though this is probably just a brain fart, I'm exhausted hence why I'm not answering many other posts right now), I can't think of anywhere in the law where potential does apply. Intent, perhaps, potential, no. Can you correct me on this, please? I'm pretty sure I'm just missing it.
